Divorce is a life altering event with great emotional and financial consequences. Whether dealing with child custody and visitation, child support, property distribution, or the other the issues involved in divorce proceedings, people experiencing marital difficulties which may lead to separation or divorce need experienced, qualified counsel, with the ability to prepare, negotiate, and skillfully present their case to a court if it cannot be settled. Our first duty to you as a client will be to answer all of your questions, and to clear up any misconceptions you may have concerning the separation and divorce process; Who will get custody of our children? What is the difference between legal custody, residential custody and physical custody? What is joint legal custody? How much child support will I have to pay? How much child support am I entitled to receive? What other types of child support have to be paid? Our goal is to explain divorce law to you and help you plan for the most efficient result possible. Michael D. Weinstein has been negotiating separations and representing divorce clients in litigated cases for over 25 years. He has handled divorce and related family law proceedings representing people in every phase of married life; from the teenaged couple who rushed into marriage, to the elderly couple whose case was contested, forced into trial and appeal after 50 years of marriage. He has handled inter-state child custody and visitation cases, custody relocation, child support non-payment cases, post divorce judgment modification and enforcement proceedings, and argued cases before the Appellate Division of the Supreme Court. This experience is invaluable in advising clients and minimizing the potential for future problems, which might otherwise be unknown to a client. Among the typical factors to be considered in most divorce cases, regardless of whether the case is settled by negotiation, or litigated and decided in Court, is the likely amount and duration of child support, whether spousal maintenance (alimony) will be available, legal vs. physical custody, visitation, the equitable distribution of property and debts, and determining whether any property is “separate”, and not subject to equitable distribution. Additional considerations include life insurance, medical insurance, and the payment of unreimbursed health related expenses. In divorce litigation, where parties litigate their dispute in Court, there are rarely ever winners or losers. In divorce mediation, or in a collaborative divorce, clients take a less combative approach in trying to negotiate the terms of the divorce and reach an agreement without the involvement of a Court. Michael D. Weinstein’s goal in representing clients faced with the turmoil of divorce and separation is to help guide you through this difficult process toward the next phase of your life, as fairly, and reasonably as possible, while protecting and preserving your rights.
